Public Procurement

The firm provides legal advice for Polish and foreign entities participating in all stages of proceedings for the award of public procurement contracts. We also advise on tenders organised by entities obliged to apply tendering procedures for projects co-financed by EU funds, which fall outside the scope of the Public Procurement Act.

Our services include:

  • The provision of advice on reviewing the compliance of procurement notices or a contract’s terms of reference (ToRs) with the Public Procurement Act and other universally applicable laws (as well as programme guidelines for EU co-financed projects);

  • We advise on formulating and submitting questions about the meaning of ToR provisions;

  • We support clients in determining the scope of required documents and statements (or their foreign counterparts) that need to be submitted in tender proceedings and we review the accuracy of such documents prior to the submission of an application or proposal;

  • We review a proposal or application for its compliance with a contract owner’s requirements;

  • We review model contracts introduced by contract owners for risks that may appear at a given stage of a contract’s completion;

  • We assess the prospects of a successful submission of an appellate remedy (an appeal or complaint);

  • We prepare appeals to the National Board of Appeal or complaints to common courts;

  • We analyse appeals submitted in tender proceedings by other bidders;

  • We represent clients in proceedings before both the National Board of Appeal and common courts;

  • We develop tender procedures and prepare full tendering documentation for entities implementing projects co-financed by the EU or advise on the preparation of requests for proposals.


We have advised manufacturing, construction and service companies that took part in proceedings for the award of public procurement contracts, including:

  • A general contractor of infrastructure projects;

  • A German manufacturer of medical equipment supplying Cancer Centres in Poznań and Łódź;

  • An engineering and design company that took part in the development of feasibility studies and design plans and specifications;

  • A major port business implementing an infrastructure project financed by the EU (we advised the client on conducting tender proceedings).
